Do You Need a Permit to Build a Pool in Utah? Everything You Need to Know

Almost every pool conversation we have in Utah starts with design — shape, depth, decking, whether there’s room for a spa. The permit question usually comes later, and it usually comes with a little anxiety: How much red tape am I actually signing up for?

The honest answer is that yes, you need a permit to build an in-ground pool essentially everywhere in Utah, and no, it is not the part of the project that should worry you. Permitting is predictable. It follows a code, it follows a checklist, and a builder who has done it a few hundred times knows what the plan reviewer is going to ask before they ask it. What actually causes delays is showing up with incomplete plans, an unclear property line, or a construction method the reviewer has to think hard about.

Here’s what the process really looks like in Utah, what it costs you in time, and where homeowners get tripped up.

The Short Answer: Yes, and Usually More Than One

An in-ground swimming pool is a permanent structure that holds tens of thousands of gallons of water, carries electrical service, and ties into your plumbing and gas. Utah municipalities treat it accordingly. For a typical residential build in Lehi, Draper, Alpine, Highland, Park City, or anywhere along the Wasatch Front, you should plan on:

  • A building permit for the pool structure itself — the shell, the excavation, the deck footprint.
  • An electrical permit for equipment power, bonding, and any pool lighting.
  • A plumbing permit for circulation lines, drains, and fills.
  • A gas permit if you’re adding a heater, fire feature, or outdoor kitchen appliance.
  • A separate fence or barrier permit in some cities, or at minimum a barrier inspection before final sign-off.
  • A grading or excavation permit if your lot is sloped, terraced, or requires a retaining wall over a certain height (frequently four feet, but check locally).

Most of these are pulled by your builder and their licensed subs as part of a single coordinated submittal. You should not be standing in line at a city counter. If a contractor asks you to pull the permit as the homeowner, treat that as a red flag — it typically means shifting liability onto you.

What Utah Cities Actually Review

Setbacks and easements

This is the number one plan-check comment we see. Cities require a minimum distance between your pool’s water edge (and often the equipment pad) from property lines, typically somewhere in the range of five to ten feet depending on the municipality and zone. Utility easements are the sneakier problem — many Utah subdivisions have a rear or side easement that looks like ordinary yard but cannot be built over. A pool designed two feet into an easement doesn’t get a variance; it gets redrawn.

Pull your plat map early. If you can’t find it, your builder can, and it should be the first document on the table before anyone sketches a shape.

Barrier and safety compliance

Utah adopts the International Swimming Pool and Spa Code, and the barrier requirements are non-negotiable. In practical terms: a fence at least 48 inches high surrounding the pool, self-closing and self-latching gates that swing away from the water, latch hardware placed high enough to be out of a small child’s reach, and no gaps a four-inch sphere can pass through. If your house wall forms part of the barrier, doors leading to the pool generally need alarms or a self-latching mechanism. Your final inspection will not pass without this, and your homeowner’s insurance carrier will almost certainly ask about it too.

Structural and engineering detail

Utah soil is not uniform. You can hit expansive clay in one part of Utah County and cobble and boulder fields in another; Summit County adds frost depth and steep terrain to the mix. Plan reviewers want to see that the pool structure has been engineered for the actual conditions — soil bearing, hydrostatic relief, reinforcement, and how the shell resists ground movement through freeze-thaw cycles.

This is the point where construction method starts to matter to your timeline, not just your budget.

Why the Build System Affects Your Permit Timeline

Two pools that look identical when they’re full of water can move through plan review very differently.

Traditional gunite construction is a wet, field-formed process: steel is tied on site, concrete is sprayed by hand, and thickness and consistency depend heavily on crew execution that day. Engineers and reviewers know this, which is why gunite plan sets often lean on generalized details and heavier reinforcement schedules to cover variability.

The Advantage Structural Foam (EPS) system we build with is an engineered, manufactured system instead of a field-mixed one. The wall components arrive with known dimensions and known structural values, and they’re assembled to a spec rather than shaped by hand. For a plan reviewer, that means the submittal contains defined, repeatable structural details rather than “it depends on the crew.” Reviews tend to be cleaner, with fewer rounds of comments.

Two more places it shows up in permitting:

  • Sloped and difficult lots. Foothill lots in Draper, Alpine, Suncrest, and Park City often mean grading permits and engineered retaining structures. The structural foam system’s lighter, modular walls work well on terraced and sloped sites and integrate with retaining wall design — which usually means less mass excavation, a simpler grading package, and a smaller footprint of disturbed soil for the city to review.
  • Energy and equipment sizing. The EPS shell is inherently insulating, which is unusual for pool construction. That matters in a climate where 30-degree October nights are ordinary. It means smaller heater loads on your gas permit and, longer term, meaningfully lower heating bills than an uninsulated concrete shell radiating warmth into cold Utah ground.

On the durability side, worth being precise about the numbers because they often get blurred together: our pools carry a 2-year warranty, and the waterproofing system is rated for 40+ years. Those are two different things — a service warranty on the build, and a performance rating on the waterproofing layer that protects the structure. The marble-clad interior finish goes on over that, giving you a hard, smooth surface that doesn’t need the replastering cycle gunite owners plan for.

How Long Permitting Actually Takes

For a straightforward Wasatch Front residential pool with a complete submittal, plan review commonly runs two to four weeks. Add time when:

  • Your lot is sloped and requires a separate grading or retaining wall review — add one to three weeks.
  • You’re in an HOA, which is its own approval track and does not run in parallel unless you start it early.
  • You’re in a mountain jurisdiction with seasonal review backlogs or additional geotechnical requirements.
  • Your submittal comes back with comments, which resets you to the back of the queue. This is the avoidable one.

Practically speaking: if you want to swim next summer, permitting should be moving in the fall or winter, not in May. Cities are slowest in spring when every pool, deck, and addition in the valley hits the counter at once.

The Inspections You’ll See During Construction

Permitting doesn’t end at approval. Expect inspectors at several stages, typically:

  • Pre-gunite / pre-shell — steel and structural components verified before the shell is closed up.
  • Rough plumbing — pressure test on lines before backfill.
  • Bonding and electrical rough — the bonding grid is the safety item inspectors scrutinize hardest.
  • Gas line — if a heater or fire feature is in scope.
  • Barrier / final — fencing, gates, alarms, and overall compliance before sign-off.

Each of these requires the work to be exposed and ready. Missed or failed inspections are the most common source of dead days in a pool schedule, which is a good reason to hire based on process discipline rather than the lowest bid.

Common Mistakes Utah Homeowners Make

Building first, permitting later. It happens more than you’d think, usually with a low-bid contractor. Unpermitted pools surface at resale, and the fix is expensive: potential demolition, retroactive engineering, fines, and a very unhappy title company.

Ignoring the HOA. City approval and HOA approval are separate. Architectural committees can meet monthly and can reject equipment placement, fence style, or deck material after the city has already signed off.

Forgetting utilities. Blue Stakes locates are required before excavation, and secondary irrigation lines — extremely common in Utah subdivisions — are often not in the locate database. They get found the hard way.

Underestimating the equipment pad. Setbacks and noise ordinances apply to equipment too. Deciding where it goes at the design stage avoids an awkward relocation later.
